PURCHASE CONDITIONS
1. Purpose and general matters.
By contracting through this website with TROPITOP you will acquire its products for a set price, which is also detailed on its page.
These general purchase conditions govern the acquisition through the website tropitop.com regarding the products offered therein.
To buy through the website, the customer must register as a user and accept these General Conditions without reservation. The purchase procedure is detailed step by step on the website once the product has been selected.
2. Capacity to contract.
TROPITOP products are intended for end consumers, for the client’s own consumption or for the people they are responsible for, as well as for companies.
By contracting, the customer acknowledges that they are of legal age and have sufficient legal capacity to be bound by these purchase conditions.
3. Information security and data protection.
The information you need to know about data protection and security can be consulted in the “Privacy Policy” tab of this website.
By registering as a user, you may receive passwords that you must use to log in and for which you are solely responsible, so you must always protect their confidentiality and take the necessary measures to prevent others from accessing them.
You are responsible for the accuracy of the data entered and for ensuring that they are your own and not those of third parties.
4. Shipping and delivery conditions.
Shipments and deliveries are carried out through specialized transport agencies, during the usual delivery hours of each logistics operator.
Shipping costs are calculated automatically during the purchase process, depending on the destination, quantity and weight of the purchased products. These will be shown in detail and transparently before completing the purchase.
The delivery service and deadlines depend on the courier company assigned to each order. At Tropitop, we work with logistics providers who guarantee fast and safe deliveries so that our fruits arrive in optimal condition.
If the transport company cannot complete the delivery after 2 attempts, or if the customer refuses the order without justified cause, we reserve the right to cancel the order without any right to a refund of the amount paid. In the event of a delay in delivery caused by the carrier, we will analyze the situation and offer a solution to the customer. In all cases, we will analyze each situation individually by contacting the customer and the transport company to offer the best possible solution.
If the shipment of your order is delayed due to the natural ripening process of the fruit or the impossibility of harvesting for any reason or force majeure, you will be notified via email and/or telephone call.
5. Prices.
All product prices available in our online store are clearly displayed along with details of applicable taxes and shipping costs at the time of purchase.
Tropitop guarantees the price shown at the time of order confirmation, even if commercial conditions are later modified or an offer ends.
We reserve the right to update prices, temporarily suspend product availability, or modify conditions without prior notice. Offers and promotions will be valid as expressly indicated on the website.
If you wish to download or print your order invoice in electronic format, you can do so from the Client Area by accessing “Your Account”. Within the "Order history and details" section, you will find a column called “Invoice”, where you can download the document in PDF format.
You can also request your invoice by email by writing to info@tropitop.com.
6. Right of withdrawal and cancellation
In accordance with consumer regulations, the customer has the right to withdraw from their purchase within 14 calendar days from receipt of the order, provided that the products are non-perishable.
This right does not apply to perishable products, such as fruits, vegetables, or any food that may deteriorate or expire quickly, as established by law.
It can be exercised in non-perishable products (for example, olive oil, honey or jam), provided they have not been opened or tampered with.
It will also not be possible to exercise withdrawal in the following cases:
- Customized or tailor-made products.
- Products that are inseparably mixed with others after delivery.
- Sealed items that cannot be returned for health or hygiene reasons and that have been unsealed.
To exercise this right, you can notify us of your decision clearly and in writing, by sending an email to info@tropitop.com, by postal mail or by using the withdrawal form model found at the end of these conditions.
Once the 14 calendar day period has expired, Tropitop will not accept returns due to withdrawal.
Order cancellation by the user will be subject to Tropitop’s usual operating process, and it will be necessary to inform of the cancellation between two and four days prior to the agreed delivery date, or 24 hours before shipment.
Cancellations made after this period will not be effective, and the Customer will have to accept the order.
7. Quality commitment and incident resolution
TROPITOP guarantees your satisfaction with the quality of the product at all times.
TROPITOP products are not subject to any artificial processes. All our fruits are harvested and shipped directly from the field, without cold storage or handling processes that could affect their freshness.
Product images on the website are for guidance and may sometimes not exactly match the appearance of the fruit received, as this is a natural and variable product.
TROPITOP guarantees the quality of the product requested and that it matches the characteristics offered by us.
At TROPITOP we work to ensure that all our orders arrive in perfect condition. However, if upon receiving your order you detect any problem (damaged, spoiled or missing product), we ask you to notify us within a maximum period of 48 hours from receipt.
Given the perishable nature of our fruits, it is important that the claim is made as soon as possible so that it can be properly evaluated. To facilitate management, it will be necessary to attach photographs or videos clearly showing the issue.
