Legal terms and conditions of the prize draw 'Conoce nuestras fincas'.

1. Identification of the organizing company.

NATURE TROPICAL FRUITS, S.L.U., with registered office at Calle Marisol, 14, 12539 Les Alqueries, Castellón, Spain, and CIF B44531150 is organizing the prize draw 'Conoce nuestras fincas'.

2. Start and end dates of the competition and geographical scope.

The start date of the competition will be 01/06/23 at 12:00 and will end on 01/09/2023 at 23:59. Participation will be open only during this period of time. 

NATURE TROPICAL FRUITS, S.L.U. reserves the right to postpone or extend the competition period in the event of force majeure, as well as the right to interpret these legal terms and conditions.

3. Rules and conditions for participation.

Natural persons over 18 years of age may participate in the competition.

The following are not allowed to participate in the campaign, and therefore be winners: NATURE TROPICAL FRUITS, S.L.U. employees, fraudulent profiles, or minors.

Nor is it allowed to participate through agents or third parties, or the use of multiple identities.

To participate, users must make a purchase through the TropiTop website, www.tropitop.com before the end date of the competition. Each completed order will count as one entry.

NATURE TROPICAL FRUITS, S.L.U. reserves the right to make changes to the campaign during its development, should any cause arise that prevent it from being carried out successfully or in order to improve its progress.

4. Selection of the winner and mode of the draw.

The selection of the winner will take place on 06/09/2023, once the entries have been closed. The draw will be carried out through an application chosen expressly for this type of draw among all the participants who meet the conditions.

There will be 1 winner and 2 alternates. The winner will be contacted via email, using the personal email address provided in the order.  If the winner has not responded within 15 calendar days, the prize will be passed on to the alternate, who will also have 15 calendar days to respond. Once the prize is offered to the alternate, the previous winner will lose the right to claim the prize. The winner must prove his/her identity through official documentation.

NATURE TROPICAL FRUITS, S.L.U. is exempt from any liability in the event of any error in the data provided by the winners/alternates, which prevents their identification.

NATURE TROPICAL FRUITS, S.L.U. reserves the right to declare the prizes void, in the event that the winners or designated alternates do not meet the requirements mentioned in these rules, as well as in the case of not being able to locate the winner and/or alternates.

5. Value and nature of the prize offered.

The prize will consist of a stay in a rural house for 2 people in the province of Castellón. It will also include a guided visit to the Finca Peña Alta (Artana) where the winner can get to know our farm and trees.

6.2. The purpose of the processing of personal data:

Advertising and commercial prospecting.  

Management of the participation in the "Conoce nuestras fincas" competition, in the development of the same, and in the designation of the winner/s.

To send subsequent promotions and marketing actions with the aim of disseminating and promoting Tropitop's activities.

6.3. Information retention periods: Participant identification data will be kept for the time strictly necessary for the development of the competition and for the legal periods that may be applicable. The data used for advertising and commercial prospecting will be kept indefinitely unless the user requests NATURE TROPICAL FRUITS, S.L.U. to unsubscribe.

6.4. Legal basis for processing: the legitimacy for the processing of data is the consent given by the participant with the participation in the contest and, therefore, with the acceptance of these rules. However, in the event of withdrawal of consent, this shall not affect the lawfulness of the processing previously carried out.

6.5. International assignments and transfers: no assignment of data to third parties or international transfers will be carried out.

6.6. You are informed of your right to lodge a complaint with the Spanish Data Protection Agency (www.agpd.es).

7. Penalties in case of fraudulent use.

Fraud is understood to be the use of independent platforms or applications to obtain more participations in the competition, as well as behavior that we detect as apparently abusive and/or malicious.

The detection of any of these practices will result in the cancellation of participation.

NATURE TROPICAL FRUITS, S.L.U. reserves the right to take legal action against those persons who perform any act likely to be considered as manipulation or falsification of the contest.

NATURE TROPICAL FRUITS, S.L.U. is exempt from any liability for damages that may be due to the temporary lack of availability or continuity of the operation of the website through which you participate in the promotion, the disappointment of the utility that users may have attributed to it and access to the different pages and sending participation responses via the Internet.

8. Transfer of image rights and/or intellectual property. 

This competition is not linked to any social media platform or network. Instagram and Facebook do not sponsor, endorse or administer this promotion in any way, nor is it associated with it. The participant is providing their information and data to NATURE TROPICAL FRUITS, S.L.U. and not to Instagram or Facebook. 

9. Acceptance of the Legal Bases.

Participation in the competition implies acceptance of these legal terms and conditions. Any manifestation of non-acceptance of all or part of the legal bases will imply the exclusion of the participant and, as a consequence, NATURE TROPICAL FRUITS, S.L.U. will be released from the fulfillment of the obligation contracted with this participant.
